    • Commentary: DWD 4.166

      After John W. Darwin married Permelia Kendrick, they settled in Union County, SC, where the 1850 census lists John as a Planter.

      At the time of John's untimely death on 18 June 1856, they had raised a family of four children who were all born in Union County. John is buried in the grounds of Hopewell Baptist Church, which is located in what is now Cherokee Co., SC, near the York County line. The epitaph on his tombstone gives no indication of the cause of death but it is suspected that he may have died of typhus which was then prevalent in the area.

      I, John W. Darwin, this day bearing in mind the uncertainty of life and the certainty of Death, Being in my right and proper mind this day and in the knollidge of all these things and having the privalidge to dispose of all the goods and property that God the all wise parent has saw fit to bestow on me and bless me with Doo this day make this my last will and testamony of all my goods and property of all kinds.

      I want my property of all kinds sold to the highest bider and then all my just debts paid first then I want the balance equally divided betwene my wife Permeler Darwin and my four children that I know I have namely Dalis, Payton, Frances & Gilly these being all that I now have. But in case that my wife Permeler Darwin should have any other children within my time or that should by the limited time be considered to be mine I want them all one and all to share and share alike that is my wife Permeler Darwin to have a childs part and the children to have the same. But my two children Payton and Gilly that is near sighted I want them to have--or if there should come any other within my time near sighted or deformed in any way whatever--I want them to have two hundred dollars more than the rest for that consideration. Also I will that the childrens part to be kept intrust until they doo marry or come of age then their parts to be paid to them also I will that my Legasy that should or may fall to me from my farthers John B. Darwins Estate or any other that may come or fall to me from any person or persons that the amount shall be kept on intrust from the time recd. until my children come of age or marry and that amount shall be equally divided betwene my children and children a loan (=alone) for their benefit and them alone by my Exetors or Administrators. Also I doo wilfully appoint my friend and Brother James G. Love and R(obert) R. Darwin for my execetors this given under my hand and seal this day and date above riten I want my Execetors to make my property bring a good price full value.
