    In the name of God Amen. I John B. Darwin of the State and Dist. aforesaid being of Sound and disposing mind and memory and calling to mind the uncertainty of life and being desirous to dispose of all Such goods as it has pleased God to bless me with do make this my last will in words following: I will that all my Just debts be paid.

    I will that all my gold mines in Union Dist. be kept leased out and the profits be put in as general funds to be divided among all my children Shall Share and share alike also all of my gold mines in York. Dist. In the Same cituation The Iron stock I want kept as general funds till it can be Sold at par, if not Sold, at general winding up then Sold to the Highest bidder by my Executors and the proceeds equally divided among all of my children so that each one Shall share and share alike.

    As to my wife Gilly Darwin, If she should change her cituation in life that is get married my will is that all my property be appraised (that is I have not willed away) and She take a childs part in lieu of her dower and the balance to be taken into possession by my Executors, If my wife should remain single till She dies then all my property to be Sold and equally divided among all my children So that each one Shall Share and share alike.

    As to my Son in law James G. Love I have his recipts for Thirteen hundred & Eighty five dollars 77 / 100 which amount I want taken out of his Share of my Estate.

    As to my Son in law David A. Chamblain I have his receipts for Seventeen hundred & five dollars 6 / 100 which amount I want taken out of his Share of my Estate.

    As to my Son in law Abraham Guiton I have his recipts for Thirteen hundred & nineteen dollars 60 / 100 which amount I want taken out of his share of my Estate I also give to my daughter Nancy M. Guiton my negroe girl Patience about Seven or eight years old to be appraised at the time she recives her and that amount taken out of her Share of my Estate and if the said Negroe girl should die before she Should receve her then My Estate to loose her.

    As to my Son John W. Darwin I have his recipts for Nineteen hundred and Sixty five dollars 33⅓ / 100 which amount I want taken out of his share of my Estate I also give to my Son John W. Darwin all the tract of Land that I bought form Wm. Tramell lying in Union Dist. on the Pinckny road containing Two hundred and Seventy five acres more or less on the waters of Mitchells creek, bounded on the north by Wm. S. Howell East by Wm. Isoms & Coln. Clowney South by H. F. Means West by Mitchells creek and H. F. Means the Said land I gave one thousand & Seventeen dollars, the Said amount is included in the above recepts the Said tract of Land I give to my Son John and his children for ever.

    I want my lands in Union Dist. (the gold mines excepted to be equally divided between my Two Sons Elnathan D. & Robt. R. Darwin, my Son Elnathan D. to have the upper end of Said tract that is up about the houses. I also give to my Son Elnathan D. my negroe boy named Henry about Sixteen or Seventeen year old if not given of in my time to be appraised by my Executor and that Said amount to be taken out of his share of my Estate the Said Land and negroe to be his and his children forever the Said Elnathan D. is to discount six hundred dollars out of his share of my estate for said tract of Land and the Said Robt. R. to have the lower end of Said tract So that each of them Shall have one hundred and forty four acres more or less and the Said Robt. R. is to discount Six hundred dollars out of his Share of my Estate for Said tract of Land and I also give to Said Robt. R. my negroe boy Anzi about fourteen years old if not given of in my time, to be appraised by my Executors and the Said amount to be taken out of his Share of my Estate the Said Land and negroe to be his and his children forever.

    As to my daughter Sarah R. Smith wife of James A. Smith I have her recepts for Twelve hundred & Eighty five dollars, I want that amount taken out of her Share of my Estate and at the general winding up of my Estate, I give her Four hundred and fifty dollars if there Should be enough to pay her that amount. I also give James A. Smith one dollar in full of his share of my Estate if he has any.

    I also give to my four Sons Marten V. and Presley P. and Elsey S. and James M. Darwin all my tract of land that is the home tract and also the Childers tract lying on Wolfs creek to be appraised and divided So that each one Shall Share and share alike, my Son James M. to have the lot about the dwelling, the Said lands to be theirs and their children forever and also give to my Son Martin V. my negroe boy George about Thirteen years old if not disposed of in my time then Said boy to be appraised by my Executors and that amount taken out of his Share of my Estate the Said boy to be his and his children forever

    I also give to my Son Presley P. my negroe boy Lewis about nine years old if not disposed of in my time then Said boy to be appraised by my Executors and that amount taken out of his share of my Estate the Said negroe boy to be his and his children forever. I also give to my Son Elsey S. my negroe boy named Calhoun about Five years old if not disposed of in my time then Said boy to be appraised by my Executors and that amount taken out of his share of my Estate the Said negroe boy to be his and his children forever.

    I also give to my Son James M. a negroe boy or money to make him equal with my three last named Sons I also will that my Executors do buy all of my children (when they become of age or marry) a horse bridel and Sadle worth Eighty dollars I also will that my Executors appraise negroes and house hold furniture to the amount of one thousand dollars to each of my daughters when they marry or become of age. I have Scholarship at Davidson College if my Children Should not take it up I want my grand children to have the benefit of it equally

    All the balance of my property both real and personal to be appraised and Stay just as it is for the use of the family that is for the tuition and board of my minor children that is So much as shall be necessary for use of the family all the Lands that I have willed my Sons they are not to come in possession of till they become of age at the general winding up my will is that all my children Sons and daughters shall share and share alike except my daughter Sarah R. Smith, I want hers to Stand as above Stated my will is that my Executors under named shall have an appraisement annully money and every thing else and Superentend the business and See the Estate is not wasted

    I hereby appoint David A. Chamblain Peyton B. Darwin & Elnathan D. Darwin my Executors to Execute this my last will in testamony where of I have hereunto set my hand affixed my seal 23 day of October 1852.
